The courts are charged with stating what the law is. It is therefore given to the rest of the United States--to the several states and ultimately to "We The People"--to state what the law is not, and what the law should be.
This was excellent. And timely given all the activity of the courts assuming authority over other branches of the govt regarding operations and decisions that are within the plenary powers of the divisions.
I think the topic needs lots of discussion as we operate under the assumption that the court is the sole arbiter when clearly many of the Founders wrote that that was not the intent.

I am pondering revisiting this thesis given what has transpired recently in this country. I'm starting to think there's more to be said here.
